UGC Regulation on Curbing the Menace of Ragging in Higher Educational Institutions-KVASU issued directions

                  UGC Regulation on Curbing the Menace of Ragging in Higher Educational Institutions, 2009 and as per the provisions of anti-ragging verdict by the Hon’ble Supreme Court vide SLP No(s)24295 of 2006 University of Kerala Vs Council, Principals’, Colleges, Kerala and Ors (with SLP(C) No.24296-99/2004 and W.P. (Crl) No.173/2006 and SLP(C) No.14356/2005)
Ragging means the following
                  Any conduct whether by words spoken or written or by an act which has the effect of teasing, treating or handling with rudeness another student, indulging in rowdy or undisciplined activities which causes or is likely to cause annoyance, hardship or psychological harm or to raise fear or apprehension thereof in a fresher or a junior student or asking the students to do any act or perform something which such student will not in the ordinary course and which has the effect of causing or generating a sense of shame or embarrassment so as to adversely affect the physique or psyche of a fresher or a junior student.
 
Punishable ingredients of ragging:
         Abetment to ragging
         Unlawful assembly and rioting while ragging
         Violation of decency and morals through ragging
         Wrongful restraint
         Assault as well as sexual offences or unnatural  offences
         Criminal trespass
         Criminal intimidation
         All other offences following from the definition of “Ragging”
         Attempts to commit any or all of the above mentioned offences against the victim(s)
              Criminal conspiracy to ragging
         Public nuisance created during ragging
         Injury to body, causing hurt or grievous hurt
         Use of criminal force
         Extortion
         Offences against property
         Physical or psychological humiliation
 
 
    Punishments
                                    Depending upon the nature and gravity of the offence as established by the Anti-Ragging Committee of the University, the possible punishments for those found guilty of ragging at the University level shall be any one of any combination of the following.
o   Suspension from attending classes and academic privileges
o   Withholding/withdrawing scholarship/fellowship and other benefits
o   Debarring from appearing in any test/examination or other evaluation process
o   Withholding results
o    Debarring from representing the institution in a regional, national or international meet, tournament, youth festival etc.
o    Suspension/expulsion from the hostel
o   Cancellation of admission
o   Rustication from the institution for period ranging from 1 to 4 semesters
o   Expulsion from the institution and consequent debarring from admission to any other institution for a specified period.
o   Fine ranging between Rupees 25,000/- and Rupees 1 Lakh
o   Collective punishment: When the persons committing or abetting the crime of ragging are not identified, the University shall resort to collective punishment.
 
Role of Head of Institutions
     
       Under Section 6 of the Act, complaints about an instance of ragging can be brought to the notice of the Head of Institution by a student, parent or guardian or teacher of an educational institution. The Head of institution shall conduct an enquiry within seven days of receipt of the complaint and if prima facie it is found true, suspend the student who is accused of the offence and immediately forward the complaint to the police station having jurisdiction over the area.
      According to the direction of supreme court in SLP (c) No. 24296-24299 of 2004, in all instances of ragging where the victim or his parent/ guardian or the head of institution is not satisfied with the institutional arrangement for action, a first information report must be filed without exception by the institutional authorities. If any victim or his parent/ guardian of ragging intends to file FIR directly with the police, that will not absolve the institutional authority from the requirement of filing the FIR
